Creator Agreement

This Agreement supplements the Terms of Service and applies when RedPatron approves you to publish or monetise content.

1. Verification and status

You must be at least 18 and complete identity, address, tax, sanctions and payout verification. Business, studio and agency accounts must disclose authorised representatives and beneficial owners. Every individual creator remains directly verified. Approval is personal, reviewable and does not create employment, partnership or agency.

2. Creator independence

You choose lawful content, pricing and publishing frequency within platform controls. You are responsible for taxes, licences, equipment, labour obligations and records applicable to your activity. RedPatron may supply tools, moderation and payment infrastructure but does not direct the manner in which lawful content is created.

3. Content ownership and licence

You retain ownership of your content. You grant RedPatron a non-exclusive, worldwide, royalty-free licence for the period content is hosted and for a limited wind-down period to host, store, reproduce, transcode, moderate, secure, watermark, display, distribute and promote it only to operate, protect and market the service. Promotion outside a paid or private area must use only assets and permissions you specifically enable. Evidence and backups may be retained as stated in the Privacy Policy.

You warrant that you own or control every required right and that no collection society, employer, agency or third party prevents the licensed use.

4. Persons appearing in content

Before upload, every depicted person must be at least 18, identity-verified and linked to a valid release covering recording, depiction, RedPatron publication, paid access and downloads where offered. You must identify every participant accurately. An agency statement is insufficient. Missing, expired, disputed or withdrawn evidence prevents publication and may block related content.

Every participant must execute the current Performer Release & Consent Agreement or a legally reviewed equivalent containing at least the same fields. Every asset requires the current Upload Declaration. Agency or studio access requires the separate Agency & Studio Authorisation signed by both creator and representative.

5. Content rules

You must follow the Content Policy, Adult Creator Addendum where applicable, and provider rules. You may not disguise NSFW content as SFW, bypass moderation, alter a rejected file to evade detection, use prohibited terms, or move prohibited transactions off-platform. Livestreaming requires separate feature approval, verified participants and real-time safety controls.

6. Pre-publication review

Uploads enter private quarantine. We may perform malware, known-CSAM hash, video-frame, age, identity, consent and policy checks and human review. No content is publishable until all required gates pass. A scanner failure keeps the upload blocked. Safety matches may be preserved and reported as required by law.

7. Monetisation and revenue share

Subject to the Payout Policy, you receive 80% and RedPatron retains 20% of qualifying creator revenue. The transaction ledger separately records gross charge, taxes, provider adjustments, platform share, creator share, refunds, chargebacks, reserves and payouts. The checkout and dashboard identify whether provider fees or taxes affect the amount considered qualifying revenue. You may not misrepresent price, renewal or deliverables.

8. Refunds, chargebacks and reserves

Refunds, reversals, chargebacks, fraud loss, taxes and provider adjustments attributable to your transactions may reduce pending or future creator amounts as permitted by law and the Payout Policy. We may hold a proportionate reserve based on provider terms and documented risk. The dashboard must disclose applicable reserve status. Negative balances may be offset against future earnings; we will not take funds without contractual or legal basis.

9. Payouts

Payouts may be weekly or monthly after the EUR 50 equivalent threshold. They require completed verification, matching beneficiary ownership, reconciled funds and no safety, sanctions, tax, provider or chargeback hold. Payment timing is an estimate until the provider confirms settlement.

10. Records, audit and cooperation

Maintain accurate identity, release, tax and rights records and respond to authorised compliance requests within the stated deadline, including the provider-required 48-hour process where applicable. You must not falsify, backdate or destroy records. We may audit content-to-performer links and suspend publishing or payouts while deficiencies are resolved.

11. Complaints and takedowns

We may immediately block content where age, consent, exploitation or legality is disputed. You must cooperate without contacting or retaliating against a complainant. Reinstatement requires complete evidence and the required human approvals. Repeat infringement or serious safety violations may terminate the account.

12. Suspension and termination

We may restrict publishing, monetisation or payouts for law, safety, provider rules, fraud or breach. We provide reasons and appeal rights where permitted. On termination, paid access, refunds, reserves, lawful payout, data export and retention are handled under the applicable policies. Content subject to investigation or legal hold is not immediately deletable.

13. Changes and law

Material adverse changes receive advance notice and renewed acceptance where required. Romanian law and courts apply, subject to mandatory rights. If a creator qualifies as a business user under applicable platform-to-business rules, the Business User Fairness & Transparency Disclosure forms part of this Agreement.

Creator operating states and subscriptions (version 2)

A Creator controls lawful plan content, prices, free subscriptions and paid offers. A free subscription never becomes paid automatically. A move from free to paid ends free access on the effective date and invites the fan to make a separate voluntary purchase. A price increase applies only after explicit fan consent before renewal; without consent there is no renewal. A price decrease applies automatically at the next renewal. A fan may explicitly choose an immediate paid upgrade: the full new price is charged, a new full period starts on confirmed settlement, and no unused-period credit or proration is applied, subject always to mandatory law.

Vacation mode accepts no new monetary support, posts, stories, messages, team activity or live activity. Existing paid access continues to its period end and free following remains. Ending vacation never creates a retroactive charge or silent renewal: each fan must explicitly consent before future renewals resume.

A Creator downgrade, deactivation or deletion stops future renewals and new money. Existing subscribers retain access to previously lawful paid content through the prepaid period. A Creator suspension instead blocks the complete catalogue and Creator operation. Content that is illegal or subject to a mandatory removal is not delivered. Mandatory refunds, reversals and legal remedies are not excluded.
